Product Warranty

1.1 Legal Warranty 24 months

Each item on sale on the site www.eeeshop.net is covered by legal guarantee, for defects of conformity, for a period of 24 months from the date of delivery, as required by Articles. 128-135 of Legislative Decree no. 206/2005 on the "Consumer Code", in Italy.

EEESHOP.net SOCIETA' COOPERATIVA, therefore, pursuant to art. 130 of Legislative Decree 206/2005, has the responsibility towards the final consumer, a natural person acting for purposes other than professional or business, for any lack of conformity of the goods at the time of delivery, within the term of 24 months starting from the date of purchase.

 

1.2 What do we intend for “item not as described” ? 

The conformity defect occurs when the article:

  • it is not suitable for the use to which it was used;
  • it does not match the description;
  • does not have the performances and / or attitudes guaranteed by the seller and typical of the purchased good;
  • does not possess the specific performances and attitudes requested by the Purchaser, when they have been the subject of specific agreement between the parties;
  • any faults or malfunctions deriving from the user's responsibility or from accidental causes or from use of the product that does not conform to its intended use and / or as provided for in the technical documentation attached to the product, are NOT within the scope of the legal guarantee.

 


1.3 When and how should the conformity defect be communicated?

Article. 132, paragraph 1 of Legislative Decree No. 206/2005 provides that the complaint of the defect of conformity, which occurred before the expiry of the legal guarantee of 24 months, must be made within the expiration period of 60 days from its discovery. In this case the Consumer can ask the seller to repair or replace the item, at his own discretion and without incurring any expense, unless the solution requested is not excessively burdensome or objectively impossible.

In order for the Customer to make use of the assistance service, he is required to keep the invoice or the delivery receipt, which he will obtain simultaneously with the purchase of the products.

In addition, the Purchaser is always allowed to download the invoices concerning their purchases, by accessing the dedicated area reserved for him on the web portal www.eeeshop.net.

1.4 What are the repair or replacement timelines?

As short as possible.

The waiting times for the repair of the product depend exclusively on the Authorized Service Center of the manufacturer.

We undertake to ensure that repairs are carried out within an appropriate period and, in any case, not later than 60 days, after which the Purchaser may request, at his choice, a reasonable price reduction or termination of the contract (Article 130 , paragraph 7).

In virtue of the device of the 3rd paragraph of the art. 132 of Legislative Decree No. 206/2005, the defect that occurs within the 180-day period from the purchase, is presumed to exist on the aforementioned date and the Consumer has the right to restore the conformity of the product, without incurring any expense , through replacement or repair.

If the Authorized Assistance Center, after checking the product, does not detect any lack of conformity, the Customer will be charged for any control / repair costs requested by the service center and shipping costs.


1.5 How to return the product to EEESHOP.net?

If the warranty provides that the goods are returned, then this return must be made in the original box, complete with all its parts (manuals, accessories, cables, etc.) by the customer.

In order to reduce damage to the original packaging as much as possible, we recommend placing the latter in an additional box whenever possible.

Under no circumstances should adhesive tapes or labels be applied to the original packaging of the item.


2.1 Manufacturer's Warranty

All products on the EEESHOP.net website, in addition to the legal guarantee, are covered by the manufacturer's conventional / commercial warranty.

The validity of this conventional guarantee does not exclude the application of the legal one, it is completely free for the Purchaser and is subject to the methods described in the instructions included in the product packaging.

The conventional warranty is provided by the Service Centers approved by the manufacturer. If, during an assistance intervention, the Authorized Center detects that the defect is not covered by a conventional guarantee, the Customer will be charged for any control / repair costs requested by the service center and transport costs, if they have been incurred by EEESHOP.net.

In the event that the product does not turn out to be functional from the first ignition, replacement will only be allowed if explicitly foreseen by the manufacturer, without prejudice to the legal guarantee. Both the replacement times and the repair of the goods will be linked exclusively to the manufacturer, provided they are reasonable. EEESHOP.net guarantees the reasonableness of such replacement / repair times.

If EEESHOP.NET, for any reason, does not have the possibility to change a warranty item to be replaced or restored, the Purchaser will have the right to choose whether to change the product with another of characteristic parts and equal or superior value, or obtain a discount voucher of the same amount that can be used for purchases on EEESHOP.net and valid for 180 days starting from the date the voucher is sent.

EEESHOP.net can not, under any circumstances, be held responsible for any delays in the completion of replacements or repairs of items under the manufacturer's conventional warranty, except in cases of gross negligence or willful misconduct.
