Right of Withdrawal

Orders at our shop are subject to the discipline of the Italian D.LGS. 206/2005, reformed as a result of Legislative Decree no. 21/2014, dictated in the matter of distance contracts, in cases where the delivery of the goods takes place at the domicile of the buyer, as these purchases are completed outside the physical stores.

To whom it applies: European Community legislation provides that the right of withdrawal can be exercised only by physical persons (end-consumers) who act for purposes that can be considered unrelated to their business. The right of withdrawal, therefore, can not be exercised by legal persons and by natural persons acting for purposes related to a commercial activity. Also excluded from the right of withdrawal are purchases made by retailers or by subjects that in any way purchase for resale to third parties.

What it consists of: the consumer has the right to withdraw from the contract within 30 days of receipt of the goods, returning the goods subject to withdrawal to the seller, who will reimburse only and exclusively the net amount paid for the property excluding additional charges such as packaging, labor, transport, fees.

In particular, the consumer who intends to make use of the Right of Withdrawal must send EEESHOP.NET SOCIETA' COOPERATIVA a specific communication within 30 days from receipt of the goods. The communication of the withdrawal must be sent by registered letter with acknowledgment of receipt or by telegram or fax, confirmed by registered letter with acknowledgment of receipt within 48 hours or PEC, to the address declared by the shop from which the goods originate.

How to return the shipment: after activating the withdrawal procedure it is necessary to insert the original packaging containing the goods in a special packaging, in order to safeguard the original wrapping of the products from any damage, writing or alteration.

We reserve the right to refuse the goods received in the hypothesis of non-compliance with the above procedure. The goods must be sent, at their own expense, to our warehouse. It is necessary to pin on the packages sent, in a visible position, the number of the RMA received. We will not accept shipments without the number of RMA on the packaging, which will be returned to the sender, at his expense. We will not be able to proceed with the reimbursement of the goods object of the withdrawal, if we do not receive the relative delivery.

Summary of withdrawal conditions

1. If the Purchaser is a final consumer, or a natural person who buys products for purposes not attributable to his business or professional activity, and therefore does not have a VAT number, then, based on art. 64 and ss. of the Italian Legislative Decree No. 206/2005, has the right to withdraw from the purchase contract regardless of the reason, without being charged any penalty and without prejudice to what is specified in the following point 3.

2. In order to benefit from the right of withdrawal, the Customer will be required to submit a withdrawal request online on the portal www.eeeshop.net within the "RMA Request" section, where he must report the bank details for the return of the amount paid. A form will be sent to the Purchaser via e-mail, which must be printed and forwarded by registered letter with acknowledgment of receipt or by PEC, within 30 days from the date of delivery of the product, to the address:

Once the registered letter or PEC has been received, we will send to the Purchaser an e-mail form to exercise the right of withdrawal, in which an authorization number is registered to be glued to the outside of the package which will constitute the return package. This package must be sent to our address within 14 days from the date of authorization.

3. Conditions to which the right of withdrawal is absolutely subject:

• The withdrawal can be exercised only for the entirety of the item purchased. Therefore, the withdrawal of individual parts of it is not permitted, such as for example: incuding software, accessories, etc.
• The right of withdrawal does not apply to computer software or sealed audiovisual articles once they have been opened.
• It is necessary that the goods to be returned be intact and inserted in the original packaging, including all its parts, such as: cables, manuals, accessories, etc. It is advisable, in order to avoid damage to the packaging, to allocate it, when possible, in an additional packaging, on which must be affixed the authorization code supplied by us. In any case, no type of adhesive tape or labels should be placed on the original packaging of the item.
• The product to be returned must necessarily be in an appropriate state of conservation, to be understood as the result of use through normal diligence. Therefore, goods that show signs of dirt or usury and therefore no longer considered intact will be rejected.
• The serial number of the item to be returned must necessarily coincide with that indicated on the sales invoice. In the event that there should be no agreement, the product will be rejected and returned to the availability of the customer, with the consequent cancellation of the request for withdrawal.
• The buyer is fully responsible for the return shipment, until it has been certified the receipt of the same at our warehouse.
• If during the transport the goods to be returned is damaged, we will inform the Purchaser about the occurrence, within 5 working days from the arrival of the product at our warehouse. In this way, the Customer will have the opportunity to quickly file a complaint against the courier selected by him in order to obtain compensation (if an insurance was previously stipulated). The article will, therefore, be returned to the Buyer's availability and the withdrawal request will be canceled.
• In no case can we be held responsible for theft, loss or damage caused to goods returned by uninsured shipments.

4. The reimbursement to the Customer of the total amount paid for the purchase of the returned product will take place as quickly as possible and in any case no later than 30 days from the arrival of the notice of withdrawal, provided that the item is received at our warehouse. The reimbursement is made through the cancellation of the amount charged to the credit card or by bank transfer, with the consequent obligation for the Purchaser to quickly communicate the bank details on which to make the payment.

5. It is radically excluded the right to withdraw, due to the violation of the conditions of integrity of the product, if we had to check:

• the absence of the original inner wrapping;
• the lack of external packaging;
• the absence of integral parts of the product, such as: cables, manuals, accessories, etc.;
• the presence of anomalies in the article;
• the presence of damages to the goods deriving from causes unrelated to transport;
• the presence of dirt on the product resulting from its use, such as to compromise its integrity.

In the event that the items are returned not intact, damaged or without original parts and accessories, we will not accept the return and will forward the goods to the Purchaser, debiting the transportation costs plus a penalty.
